I was attacked & bitten by a large dog while I was in Hardin, Montana, for my father's funeral. I was walking, en route to my brother's house. As soon as I reached his house, I called the Big Horn County Sheriff's Office. Officer Pete Molina responded, took pictures of the bite, asked me a few questions and advised he would drop a blank statement off for me to fill out. He brought the statement form by, I filled it out, called the Sheriff's Office to advise Officer Molina he could pickup the statement, which he did later. At that time Officer Molina advised me that he had informed the dog owner that they were in violation of the city leash law by allowing the dog to run at large and that he was going to cite them for 'dog at large' and 'vicious dog'. My brotherwalks by that same house every day with his dog and reported to me that the owners must have gotten rid of the dog because he hadn't seen it for several days. However, on January 15, 2011, by brother and his dog passed the same house and the same dog that bit me, also tried to bite him. This incident was witnessed by a neighbor who lives across the street. I wish to pursue a lawsuit against the City of Hardin as well as the dog owners, for not destroying the vicious dog. If the dog had been disposed of initially, I would have been satisfied. However, I don't feel the City of Hardin nor the dog owner took the incident seriously. As a side note, there are several small children living on that street and many people, including my brother & my 76 year old mother, walk on that street since there are no sidewalks. Please advise in I have legal standing to pursue this incident.
