Daniels-Leslie v. Laster11/2/2004 issal with prejudice is harsh, we cannot say that it is inappropriate in light of plaintiff's repeated failures to comply with the trial court's orders regarding discovery. As such, the record is bereft of any evidence that the trial court abused its discretion in dismissing plaintiff's claim. The assignments of error directed at the trial court's order dismissing plaintiff's claim pursuant to Rule 37(b)(2)c are overruled; the assignments of error directed at the trial court's order dismissing plaintiff's claim pursuant Rule 9(j) need not be addressed and are therefore dismissed.
Affirmed.
Judges GEER and THORNBURG concur.
Report per Rule 30(e).
