nstead, the court properly considered the evidence relevant to the parties' ability to pay. The Apodacas clearly were not in a position to pay Defendant's costs. Although the Velasquezes had more resources than the Apodacas, there were other factors the trial court could have taken into consideration given the evidence presented.


CONCLUSION


For the reasons stated above, we affirm the judgment below. Defendant AAA Gas's cross-appeal is denied.
