the following order: Good cause appearing therefor, the above entitled action is hereby dismissed under the provisions of section 581 et sequitur of the Code of Civil Procedure, with prejudice as to each cause of action set forth in the first amended complaint with the exception of the first cause of action as to defendant Donald J. Gavrity."
That part of the appeal challenging the trial court's sustaining without leave to amend defendant Gavrity's demurrer to the claim of negligent misrepresentation against him is dismissed.
In all other respects, the judgment (order of dismissal) is affirmed.
The parties are to bear their own costs.
