Breezevale Limited v. Dickinson9/21/2000 t's exercise of discretion in the imposition of sanctions. I think it important to emphasize that, as the trial judge pointed out, the issue as to which Breezevale presented fabricated evidence was "the core question presented by the [malpractice] case." Even if we assume, in light of the jury's verdict, that Breezevale's action against GDC was "not in itself brought in bad faith," see Synanon Found., Inc. v. Bernstein, 517 A.2d 28, 38 (D.C. 1986) (Synanon II), it is significant that Breezevale's key allegation in the malpractice case was untrue and known by Breezevale to be untrue. The testimony offered in support of that allegation was likewise false. The final disposition of this case should reflect this underlying reality.
