Puckett v. Oakfabco Inc.6/2/1999 failed to set forth any evidence which would create a genuine issue about whether Oakfabco had made a representation upon which Puckett relied. Therefore, the district court properly granted Oakfabco's motion for summary judgment on Puckett's claim for fraud.
IV.
CONCLUSION
For the reasons stated above, we affirm the trial court's decision granting Oakfabco's motion for summary judgment on each of Puckett's claims. We award costs to Respondent on appeal.
Justices SCHROEDER, WALTERS and Justices Pro Tem JOHNSON and BURDICK, CONCUR.
