Owens v. Silvia12/22/2003 on a voluntary basis. Lastly, the trial justice did not abuse his discretion in failing to conduct an in limine hearing before permitting the defendants to introduce into evidence the informed-consent form that Owens signed before undergoing this surgery.
For these reasons, we reverse in part and affirm in part the challenged rulings of the trial justice, vacate the judgment for the defendants, and remand the papers in this case for a new trial consistent with this opinion.
