Smith v. State Compensation Fund2/17/2000 ident occurring afterwards at least raises a significant question as to that ground for waiver.
Claimant's strongest argument for benefits is his financial situation. Even then 610 benefits would only postpone the financial crises. More importantly, in light of the other factors, his financial situation is not enough to carry the day.
ORDER
The claimant's request for benefits under section 39-71-610, MCA, is denied.
