Nedrow v. Pruitt9/13/1999
court erred in denying Nedrow's motion to strike the defense of assumption of the risk. As a corollary to this argument, she argues the trial court erred by charging the defense. Davenport, however, applies only to causes of action accruing after the date of the supreme court opinion. Davenport, supra. Because Nedrow's injuries occurred before that date, Davenport does not apply.
REVERSED and REMANDED.
