Lecy v. Burlington Northern6/24/2003 not prevented from seeking alternative work assignments or taking other steps to protect himself, the continuing-torts doctrine does not apply, and the statute of limitations was not tolled. Because the record is unclear as to when appellant's left knee became symptomatic of degenerative arthritis or even what, in fact, caused the injuries to the left knee, there are genuine issues of material fact in dispute and that claim is not time-barred.
Affirmed in part, reversed in part and remanded.
