In re Anderson8/2/2001 rd and the Hearing Committee on the issue of Anderson's degree of culpability, we have carefully examined the record to decide whether, in light of our precedents, his misappropriation carried with it aggravating circumstances enough to warrant the severe discipline Addams imposes. Ultimately, we agree with the Board that his misappropriation did not rise to that level, consisting essentially as it did of a single mistaken failure to pay a client obligation aggravated by commingling and inadequate record-keeping - failings which, though inexcusable, do not take it beyond negligence under our decisions.
We therefore accept the Board's recommendation that respondent be, and he hereby is, suspended from the practice of law in the District of Columbia for six months. The time before which respondent may apply for reinstatement will commence upon his filing of the affidavit required by D.C. Bar Rule XI, § 14. See D.C. Bar Rule XI, § 16 (c).
