City of Laredo8/22/2001 t.), that the plaintiff's allegations that the Department of Public Safety failed to furnish proper training, instruction, manuals, and documents to the defendant were not barred because a nexus existed between these failures, the defendant's misuse of tangible personal property, and the plaintiff's injuries.
We are persuaded that the claims against the city are not barred by the Tort Claims Act. Given our holding that summary judgment for Cordova on the basis of official immunity was improper, thus leaving open the question of the city's liability, we further hold that the plea to the jurisdiction should not have been granted.
We sustain issue one.
conclusion
We reverse the trial court's judgment and remand the cause to the trial court for further proceedings.
