We pause to note that the Palacios decision issued five days before oral argument in this Court. Most certainly, the trial court did not have the benefit of the Supreme Court's pronouncement at the time of the hearing below. Nevertheless, we must conclude that dismissal of the cause of action constitutes an abuse of discretion. We sustain Issues One through Five and reverse and remand to the trial court.
