Louisiana Pacific Corporation v. Gill

motion for new trial. Even if we agreed with Louisiana Pacific that the evidence is insufficient to support an award of exemplary damages, we would remand that issue along with the rest of the case on the basis that the interests of justice would require it in view of the fact that only a very limited evidentiary hearing was held in view of the default. In view of the remand, we need not consider Louisiana Pacific's contention that the evidence is factually insufficient to support the award of exemplary damages. We overrule Louisiana Pacific's contention as presented in issue one. In view of our determination of issues one and two, we need not consider issue three.


We reverse the judgment and remand this cause for trial.


REVERSED AND REMANDED.
