Heimer v. Venegas

11/21/2002

, [conduct] unnecessary discovery, or [engage] in other tactics that are frivolous or solely intended to cause unnecessary delay." Among other things, the record reveals that Heimer's complaint sought damages against Venegas for causes of action that had no factual or legal basis, she failed to comply with discovery which required Venegas to file discovery motions, a special master had to be appointed to preside over her deposition at Venegas's expense, and she filed frivolous motions in the trial court, including motions for sanctions and a request that a warrant be issued for Venegas's arrest. The documents in the record provide ample support for the trial court's determination.

The judgment in Case Nos. 1037549 and 1043792 is affirmed. The parties shall bear their own costs.

NOT TO BE PUBLISHED.
