Ahmed v. Department of Social and Health Services8/18/2000 without merit because the federal verdict was rendered after the Board's decision.
One of the elements of collateral estoppel is that the party against whom the plea is asserted must have been a party to or in privity with a party to the prior adjudication. Department of Ecology v. Yakima Reservation Irrigation Dist., 121 Wn.2d 257, 296, 850 P.2d 1306 (1993). Here, the federal verdict was rendered after the Board completed the appeal. Thus, there was no prior adjudication to estop the Board.
We affirm.
