Ahmed v. Department of Social and Health Services8/18/2000 th a patient's oncology appointment. Reasoner had previously notified Ahmed in writing of the appointment. Thus, when Ahmed called her, she thought he wanted the results of the appointment and referred him to Harborview Medical Center. When Ahmed called Harborview and learned the patient was already there, he became upset and yelled at Reasoner for not telling him of the appointment during his first call.
E. Additional Testimony
In addition to these incidents, others testified regarding Ahmed's behavior. Marci-Kaap Connors, who regularly works with Ahmed, testified that their working relationship is great now but that it 'started out on a rocky road.' She described Ahmed as a perfectionist who wants things done a certain way. Other nurses would come to her, rather than deal directly with Ahmed, because Kaap-Connors got along with him. She admired his work with patients.
Dr. Ruvalcaba, the clinical director and Ahmed's supervisor, knew that Ahmed had a hearing problem. But Ahmed told Dr. Ruvalcaba that his disability had never been a problem and that he did not wear his hearing aid all of the time. Ruvalcaba said that 'mutual respect among staff is important and that regardless of the competency of a physician, it is impossible to provide good client care unless there is a good working relationship between the physician and the nursing staff.'
Leana Lamb, the school superintendent, said that during the pre-disciplinary hearing Ahmed offered no justification for his behavior. His representative said that he was a doctor and did not need to be nice to anyone; nurses needed to follow his orders. Lamb felt that staff members were reluctant to raise concerns about Ahmed for fear of retaliation. She concluded that he was abusive to patients and staff, that he had violated policy and created a hostile and intimidating work environment that hurt patient care. Based on these findings and his inappropriate demeanor during the review process, Lamb did not trust Ahmed with the patients' welfare. She decided to terminate him.
Ahmed filed his notice of appeal with the Board on January 15, 1997. On February 11, 1997, Ahmed's counsel notified the Board that he had been retained and he requested mediation. The Attorney General's office filed a notice of appearance seven days later. On February 19, 1997, Ahmed's counsel notified the Board that mediation was no longer an option and requested that 'a status conference be scheduled and that the hearing date be set promptly.'
On April 7, 1997, the Board's hearing coordinator wrote to Ahmed's attorney, confirming their conversation of April 1, 1997, 'about scheduling the above matter for hearing for sometime between July and September 1997.' She also said that the Attorney General's office had notified her that the case was being reassigned. And, because she had not yet received a notice of withdrawal and substitution of counsel, she advised Ahmed's attorney that she was unable to proceed with scheduling.
On April 9, 1997, Ahmed's counsel wrote to the Board. He confirmed his earlier actions, said he was available during May, July, or August and said, 'Please take whatever action is necessary to provide Dr. Ahmed with a hearing date as soon as possible. The ongoing delay is causing Dr. Ahmed great hardship.'
The Attorney General's office filed notice of substitution of counsel on May 5, 1997. On May 9, 1997, Ahmed's counsel wrote to the Attorney General's office requesting that the hearing be set immediately. A pre-hearing conference was held on May 14, 1997, and continued until May 19. The parties stipulated that the hearing would be held on October 29 and 30, 1997. A statement from the
