Middleton v. Beckett5/14/1998 affirmed, subject to plaintiffs' right to appeal those rulings. If the court finds that defendant's exercise of peremptory challenges was not constitutionally permissible, then it must grant plaintiffs a new trial, subject to defendant's right to appeal that ruling. If the court determines there was a discovery violation by defendant, it may impose an appropriate sanction, again subject to defendant's right to appeal that ruling.
