Takayama v. Kaiser Foundation Hospital

8/30/1996

akayama's claim regardless of any assigned error regarding the two motions because: (1) we affirm the trial court's ruling regarding Takayama's proffered rebuttal evidence; (2) Takayama did not challenge the jury's finding in the trial court that Dr. Robinson was not negligent and therefore did not breach a duty to Takayama; (3) she also does not otherwise challenge the finding on appeal; and (4) the issue of causation is therefore moot. Accordingly, we hold that any error in the trial court's denial of Takayama's motions for directed verdict or for JNOV or new trial was harmless.

IV. Conclusion

For the foregoing reasons, the judgment of the trial court is affirmed.

Ronald T.Y. Moon, Robert G. Klein, Steven H. Levinson, Paula A. Nakayama, Mario R. Ramil
