Plaintiff had the right to assert any claim which the laundry could have brought against defendant. Plaintiff took the place of the laundry and took on the same rights and responsibilities as the laundry would have had in a tort action. Because the statute of limitations would have run on the laundry's right to file the cause of action on 11 November 1991, plaintiff lost its right to file the suit after that date.
