Our resolution of plaintiffs first and second assignments of error renders plaintiffs third, fourth and fifth assignments of error moot, and we do not reach the issues raised by those assignments of error. App.R. 12(A)(1)(c).
Having sustained plaintiffs first and second assignments of error, and having found plaintiffs remaining assignments of error to be moot, we reverse the judgment of the trial court and remand this cause to the trial court with instructions to reinstate the jury's verdict.
Judgment reversed and cause remanded with instructions.
