Burlington Northern Railroad Co. v. Hood12/10/1990 clusion of Mrs. Hood's trial testimony, Burlington again made known to the trial court its desire to cross-examine both Hood and his wife about Hood's alleged admission. The trial court, however, adhered to its previous ruling and prohibited such interrogation. The record clearly shows that Burlington, which was adversely affected by the trial court's ruling, adequately made the trial court aware of the substance of the evidence which it desired to present. The court of appeals erred in reaching a contrary conclusion.
The judgment is accordingly reversed and the case is remanded to the court of appeals with directions to return the case to the trial court for a new trial.
Disposition
JUDGMENT REVERSED AND CASE REMANDED WITH DIRECTIONS.
