This dispute has been in court since 1985. The parties are entitled to an answer. They should not be sent back to the trial court for more discovery, investigation of the reasons why the legislature might or might not have acted as it did, a trial on that question, and another inevitable appeal. If, in order to decide this appeal, we feel that we need additional information, we should ask the parties to supplement their briefs and provide it to us.
