McFarland v. Entergy Mississippi10/6/2005 was properly submitted to the jury under Miss. Code Ann. ยง11-7-17, "All questions of negligence and contributory negligence shall be for the jury to determine." This jury found that Entergy was negligent in its duty to warn and this decision should be upheld.
. After a complete and thorough review of each and every page of the record before me, I find that there is sufficient evidence to support the jury's verdict in favor of McFarland. It makes no difference whether I personally agree or disagree with the jury's verdict. However, the majority's opinion strays from the precedent of this Court and violates the prerogative of fairminded jurors, who were properly instructed on the law. Accordingly, the verdict should be reinstated. Therefore, I must respectfully dissent.
