But vicarious liability does not convert a non-tortfeasor into a tortfeasor, and exposure to liability ceases once there has been a resolution of the controversy involving the person or entity that triggered the possibility of vicarious liability. In plain English, once Gould was released, Hyundai was no longer exposed to liability.
For these reasons, the judgment is affirmed, and the papers may be returned to the Superior Court.
