In re C.M.C.8/3/2005 rights to C.M.C., C.L.C., and D.A.M. DCS has failed to prove by clear and convincing evidence the existence of any statutory grounds for termination. Because DCS has failed to carry its burden to prove grounds, we do not reach the question of whether termination of Mother's parental rights is in the best interests of the children. Costs of this appeal are taxed to the Appellee, the State of Tennessee, Department of Children's Services.
