The plaintiff's attorney conceded that he would be unable to prove the case without an expert witness. We are, therefore, of the opinion that in dismissing the plaintiff's complaint the trial justice did not abuse her discretion.
Conclusion
For the foregoing reasons, the judgment of the Superior Court is affirmed and the papers in the case are remanded to the Superior Court.
