Automobile Accident Wrongful Death; Negligent Hiring, Training and Entrustment; $325,000 Settlement

I recently settled a wrongful death lawsuit, which was based on a negligent hiring theory, for $325,000. The decedent, a twenty-year-old female, was killed in an intersectional automobile collision. The vehicle that collided with my plaintiff's vehicle was operated by a woman who did not have a valid driver's license; had operated without a license for several years; and perhaps most importantly, regulary drove well in excess of the speed limit at the very point where the subject accident occurred. I also learned that her employer had performed a poor investigation of her driving background prior to hiring her, and had placed her first cousin and sister in supervisory capacities. The $325,000 settlement exceeded the decedents' future lost wages by more than a factor of four.
