18 wheeler Rear-end collision; Cervical and lumbar herniation; No surgery; $500,000 Settlement

I recently settled personal injury action in which a small passenger car was rear-ended on a Mississippi Gulf Coast highway by an 18 wheel tractor/trailer. The plaintiff was the driver of the vehicle, and claimed to have suffered two cervical herniations and one lumbar herniation in the accident. Although the plaintiff had not undergone surgery at the time of the settlement, his treating physician had recommended both lumbar and cervical surgery. The case settled for $500,000 on the eve of trial.
