Plaintiff is treated for pain, which is initially diagnosed as tendonitis. After obtaining an individual health insurance policy with Blue Cross & Blue Shield of Mississippi (BC/BS), plaintiff is diagnosed with Rheumatoid Arthritis. BC/BS denies payment of claims associated with diagnosis and treatment of Rheumatoid Arthritis on the basis of its pre-existing condition exclusion, claiming the treatment of tendonitis was actually for Rheumatoid Arthritis. Plaintiff sued, claiming that she had not been treated for Rheumatoid Arthritis, since it had not yet been diagnosed.
BC/BS settled shortly after filing suit for $3,850.
