In August of 1999, Tammy Jones, a young vibrant, strong and healthy woman, was riding on the back of her boyfriend’s motorcycle on the way to a Harley Davidson Road Rally when they came upon construction traffic in Grand Rapids, Michigan.

They were rear-ended by a pick-up truck driver who was in a big hurry to avoid the traffic. He tried unsuccessfully to cross three lanes of traffic and ran into the rear of the stopped motorcycle on which Tammy was riding. Her left leg was severely injured with multiple fractures which necessitated the surgical insertion of pins and rods in her leg.

What made this case difficult was that the location of the crash and subsequent trial - Grand Rapids, Michigan. Historically, this region with its rich Dutch heritage tends toward lean awards for injury cases. Jurors are usually quite conservative. Coupling this with the fact that Tammy was riding on the back of a motorcycle and going to a Harley-Davidson road rally in Idaho, the insurance adjuster evaluating the case felt a small award was appropriate. It was his opinion that her injuries were severe due to her being on the back of a motorcycle, a choice she made. By mounting a careful and thorough investigation before the suit was filed, we were able to obtain written and signed statements from witnesses as to the speed and reckless lane changes of the defendant driver and consequently achieved an excellent result.

The defendant settled after mediation for a substantial amount.
